Agency staff play a vital role in keeping health and social care services running, but the introduction of joint and several liability for PAYE / NI in April 2026 could significantly change the risk profile of using temporary labour.

Under the new rules, care providers may be pursued for the full cost of certain PAYE / NI liabilities, where an agency (or other third party) is involved in the supply of temporary workers.

For senior leaders and compliance teams, this legislation is a wake-up call. Existing assumptions about risk transfer, indemnities, and agency accountability may no longer hold up.
